ARTICLE 1
Name:
The name of this organization shall be University
Professional and Technical Employees, UPTE Local 8, an affiliated of University
Professional and Technical Employees Communication Workers of America (CWA)
Local 9119.
ARTICLE 2
Affiliations:
This local union shall be affiliated with the
UPTE-CWA Local 9119.
ARITCLE 3
Objectives:
The objective of this local shall be to carry out
on a local basis the objectives of UPTE.
ARTICLE 4
Membership and Dues:
Section 1:
All non-exclusively represented employees of the

Application of membership shall be made on a
standard form. Unless such form includes a valid authorization for payroll
deduction of dues, the application shall be accompanied by the first month’s
dues.
Section 4:
The monthly membership dues of this local shall be
in accordance with the Membership Application Form.
Section 5:
Membership dues shall be payable monthly in advance
to the local’s treasurer or other authorized representatives and in event shall
be paid not later than the 15th day of the month in which they
become due shall be considered delinquent, and upon failure to suspended.
Provided however, that any person who is paying his/her dues through a system
of regular payroll dues deduction shall, for so long as he/she continues to pay
through such deduction method, be considered in good standing.
Section 6:
A member suspended under the above section shall be
reinstated to membership in the local on payment of a reinstatement fee equal
to two months dues plus th4e current month’s dues.
Section 7:
UPTE Local 8 shall comply with UPTE-CWA Local 9119
monthly dues rate change, as approved by the annual convention.
ARTICLE 5
Section 1:
Regular meetings of this local shall be held once a
month, at a time and place to be fixed by the membership of the executive
board.
Section 2:
Special meetings may be called by the President, by
the executive board, or by petition filed with the President and signed by 15%
of the general membership. Special meetings may also be called by UPTE-CWA
Local 9119 executive board.
Section 3:
A quorum of a regular membership meeting shall
consist of 8% of the general membership; quorum of a special membership meeting
shall consist of 10% of the general membership. Reasonable attempts shall be
made of notify all members of meetings.
ARTICLE 6
Officer, Nominations and Elections
Section 1:
The officers of this local shall be a President, a
Vice President for the campus and the medical center, a Secretary, a treasurer,
a systemwide representative, four executive board members at-large and these
nine shall constitute the local union executive board.
Section 2:
Nominations for all officers shall be made at a
regular meeting of the local. At least fifteen days advance notice shall be
given the membership prior to the opening of nominations. A nominating
committee is used; nominations shall be permitted from the floor at the
nominations meeting.
Section 3:
To be eligible for office a member must be in good
standing for at least four month immediately preceding the election, except in
the initial election held in this local. For a member who is transferred into
this local from another UPTE local. This requirement shall be satisfied if such
member’s combined membership in good standing in both locals is at least four
months at the time of the election.
Section 4:
Officers shall be elected by secret ballot vote,
and the balloting shall be so conducted as to afford to all members a
reasonable opportunity to vote regardless of work schedule or work location. At
least fifteen days notice shall be given the membershi0p prior to the close of
balloting. This notification shall be mailed or e-mailed to each time and place
of the election.
Section 5:
All matters concerning nominations an elections in
this local union shall be subject to the provisions of Appendix 10, entitled
Elections Code, of
the UPTE_CWA Local 9119 constitution
Section 6:
a.
If less
than four months remain in the term, vacancies shall be filled by vote of the
executive board;
b.
If more
than four months remain to be served, the vacancy shall be temporarily foiled
as in Section 6(a) above, with new elections held as soon as possible, but in
no case more than sixty days after the office is vacated.
ARTICLE 7
Duties of Officers and Executive
Board:
Section 1:
The President of the local is the chief executive
member of this union charged with administrating the affairs and executing the
policies of the union as determined by the general membership and executive
board, shall report periodically to the membership regarding the progress and
standing of the local and his/her official acts, shall appoint all standing
committees and all special committees of the local, subject to the approval of
the executive board.
Section 2:
The vice President shall perform the duties of the
President in the President’s absence. He/She may co-sign checks
Section 3:
The Secretary shall be responsible for the minutes
of all meetings of the general membership and the executive board. He/she may
so-sign checks.
Section 4:
The Treasurer shall receive and receipt for all
monies of the local union and shall deposit all money so received in the name
of the union I the bank or banks selected by the executive board. Money so
deposited shall be withdrawn only by check or election fund transfer singed by
any two of the following three officers: President, vice President, Secretary,
and treasurer. The treasurer shall prepare checks of such purposes as are
required by the constitution or are authorized by the membership or the
executive board. He/ She shall keep an accurate record of the receipts and
disbursements and shall, once each month, submit to the membership a monthly
operating statement of the financial transactions of the properties of the
local union and shall, at the expense of the local union and through UPTE-CWA
Local 9119 give a surety bond for the amount to be fixed by the executive board
of the local union. He / she shall see that any financial reports required by

Section 5:
The systemwide representative shall attend all
meetings of the UPTE-CWA Local 9119 executive board and report the business
conducted there in to the UPTE Local 8 executive board.
Section 6:
The executive board shall be the governing body of
the local union between meetings of the general membership. All matters
affecting the policies, aims and means of accomplishing the purposes of the
local not specifically provided for in this constitution or by the actions of
the membership at a regular or special meeting shall be decided by the
executive board. The board shall meet at the cal of the President or a majority
of the members of the board, a report on all actions taken by the executive
board shall be made to the membership at the following general membership
meeting. A majority of the membership o the executive board shall be required
for a quorum. The responsibility of the executive board shall be to the general
membership.
ARTICLE 8
Committees:
Standing
committees may be established, as needed, by the general membership or by the
executive board, subject to the approval of the general membership at a regular
or special meeting.
ARTICLE 9
Miscellaneous Provisions:
Section 1:
This local union shall at all times be subject to
the provisions of the UPTE-VWA Local Constitution.
Section 2:
Except to the extent specified I this constitution,
no officer of the local union shall have the power to act as agent for or
otherwise bind the local union in any way whatsoever. No member or group of
members or other person or persons shall have the power to act on behalf of r
otherwise bind the local union except to he extent specifically authorized in
working by the President of the local union or by the executive board of the
local union.
Section 3:
Robert’s rules of Order, Newly Revised, shall be
the guide in all cases to which they are applicable and in which they are not
inconsistent with the local’s constitution or with any legally adopted special
rules of UPTE-CWA Local 9119.
ARTICLE 10
Amendments:
Amendments shall be I accordance with the UPTE-CWA
Local 9119 Constitution, Article 15, entitled Amendments.
